O R D E R 11.12.2025 Heard Mr. A.K. Azad, the learned counsel appearing for the petitioner. I have also heard Mr. R.J. Baruah, the learned Addl. Public Prosecutor, Assam.
2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner, namely- Nekib Ali has prayed for regular bail in respect of Rangia P.S. Case No.352/2024, registered under
Page No.# 2/2 Sections 103(1)/3(5) of BNS, 2023 corresponding to Sessions Case No.18/2025 pending in the court of learned Addl. District and Sessions Judge, Rangia, Kamrup.
3. The case is at the trial stage. It is alleged that the wife of Badir Ali and Nekib Ali jointly killed the deceased.
4. The case record has been received. Perused the relevant portion thereof.
5. It is emerged from the statement of one witness that the deceased’s wife told police that she had killed her husband. There are also materials to indicate that the present petitioner used to visit the house of the deceased.
6. However, considering the stage of the case (trial) and the length of detention, this Court is inclined to grant bail to the petitioner.
7. Accordingly, the petitioner, namely- Nekib Ali who was arrested in connection with Rangia P.S. Case No.352/2024, registered under Sections 103(1)/3(5) of BNS, 2023 corresponding to Sessions Case No.18/2025 pending in the court of learned Addl. District and Sessions Judge, Rangia, Kamrup, shall be released on bail of ₹48,000/- with a surety of like to the satisfaction of the said court i.e. learned Addl. Sessions Judge, Rangia, Kamrup subject to the conditions that – (1) the petitioner shall not abscond and be available for trial; (2) the petitioner shall not hamper or tamper with evidence and (3) the petitioner shall not try to influence any witnesses.
8. Violation of breach of condition(s) shall entail cancellation of the bail. With the above direction, the present bail application is disposed of.
