The petitioner has been made accused in connection with Simdega P.S. Case No. 74 of 2024, for the offences registered under Sections 414 of the I.P.C. & 20(b)(ii)(c)/22(c) of the N.D.P.S. Act, pending in the Court of learned Session Judge-Cum-Special Judge, Simdega. 3. On 15.06.2024, at about 09:25 a.m., Simdega Police, on the basis of confidential information intercepted a Ecco Sports car bearing Registration No. OD 14A 7711 near Namaji Complex at National Highway NH-143. On search, 154.910 kgs of cannabis were recovered from the said vehicle. The petitioner who is the driver of the seized vehicle was apprehended at the spot. 4. Learned counsel appearing on behalf of the petitioner has submitted that some of the accused persons have been granted bail by this Court. It was further submitted that the packages which were seized were not sealed at the place of occurrence. It was finally submitted that the seized packages were not numbered which is contrary to the decision of the Hon’ble Supreme Court laid down in Sandeep versus State (NCT of Delhi), 2024 SCC Online Del 451. 5. Considering the fact that the commercial quantity of cannabis was recovered from the said vehicle which was used by the petitioner for transporting it, I am not inclined to release the petitioner, on bail.
