1. This is an office reference. 2. This Court, vide order dated 22.04.2024, passed in MCRC No. 2308 of 2024, while allowing the bail to the petitioner, namely, Bhibhun sahu and Bira Sahu, had expressed its trust that the trial Court should make an VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.06.17 19:45:36 +0530
2 earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of 06 months from the date of receipt of a certified copy of the order, if there was no legal impediment. 3. Earlier on two occasions also, this Court had granted extension of time for compliance of the order dated 22.04.2024. 4. The learned Special Judge (NDPS Act), Saraipali District - Mahasamund (C.G.) vide his request letter dated 07.05.2025 has requested for grant some more time for concluding the trial. 5. It transpires from perusal of the PUD, that in the present case, In court a total of 200 special session cases of NDPS and 504 other cases are pending An attempt has been made to resolve the matter quickly by giving dates next to next. Evidence of 04 prosecution witnesses has been recorded in the case. As per the trial program in the case, evidence of 10 prosecution witnesses is yet to be recorded. Summons/bailable warrants/arrest warrants are being issued continuously to the witnesses in the case, but evidence could not be recorded due to the absence of prosecution witnesses. Honorable Sir, I have taken charge as Special Judge NDPS on 26.03.2025. For the first time, the case has been placed before me for trial on
07.05.2025. The case has again been issued bailable warrants to the witnesses for prosecution evidence on 14.05.2025, 15.05.2025 and 16.05.2025 through Superintendent of Police Mahasamund. After recording of evidence of 10 prosecution witnesses in the case, statement of charge, final arguments and defence evidence are to be taken, due to which the case could not be resolved within the stipulated time limit as per the order of the Honourable High Court.. Considering the number of witnesses, it is likely that the final resolution of the said case will take time and additional time is required. Due to this reason, it is not possible to conclude the trial within the
3 time prescribed by this Court. Hence, he prays for grant of some more time for concluding the trial.
6. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of three months from today.
7. Accordingly, this CRMP stands disposed off with the aforesaid direction.
8. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
