Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 16-07-2025 1) Heard on admission. 2) By way of this petition, petitioner has sought following reliefs:- 10.1 That the Hon'ble court kindly be pleased to issue a direction to the respondent no. 2 to Digitally signed by AJINKYA PANSARE Date: 2025.07.17 10:20:45 +0530 2 constitute a District Level demarcation committee for demarcation of petitioner's land which is acquired for construction of Khairagarh - Lanji Road, Or if the Hon'ble Court may deem fit and proper issue an order directing the respondent no. 2 to take prompt action for demarcation of land of the petitioner by any other revenue officer. 10.2 That, the Hon'ble Court may kindly be pleased to direct the respondents that after demarcation if it is found that the land of petitioner is acquired than provide the fair compensation in accordance with law to the petitioner. 10.3 That, the Hon'ble court may kindly be call for the records for its kind perusal which relates to petitioners matter. 10.4 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioners. 3) Learned counsel for the petitioner submits that some part of the land belonging to petitioner bearing Khasra No. 299/1 ad- measuring 0.680 hectare situated at Village Amlidih Khurd, P. H. No. 18 [Now 30], Tahsil Khairagarh, District Rajnandgaon (C.G.) was acquired by the respondents for construction of Khairagarh – Lanji Road in the year 2018-19. He further submits that demarcation was conducted by the respondent authorities and according to which, it is clear that 0.130 hectare land of petitioner has been used for construction of the road. He contends that letter was issued by SDO(R), Khairagarh i.e. respondent No. 3 to Executive Engineer Public Works Department, Division Khairagarh i.e. respondent No. 6 but till date, no proceeding has been initiated with regard to acquisition of land and payment of 3 compensation. He further contends that this petition may be disposed of directing respondent No. 6 to take appropriate steps. 4) On the other hand, learned State counsel opposes. 5) Heard. 6) Admittedly, 0.130 hectare of land belonging to petitioner has been used for construction of road in the year 2018-19 which is evident from demarcation report and no acquisition proceeding has been initiated and compensation has also not been paid. It appears that respondent No. 3 wrote a letter to respondent No. 6 to take appropriate steps in this regard but till date, no action has been taken, therefore this petition is hereby being disposed of directing respondents No. 3 and 6 to take appropriate steps with regard to acquisition of land belonging to petitioner and payment of compensation. 7) With the aforesaid direction(s), this petition stands disposed at admission stage. 8) It is expected that the entire exercise shall be completed by SDO(R), Khairagarh and Executive Engineer Public Works Department, Division Khairagarh within period of six months from today.
