Bora, learned counsel for the respondent No. 2. The present appeal has been instituted assailing the judgment dated 25-02-2014 passed by the learned Addl. Chief Judicial Magistrate, Jorhat in C.R. Case No. 23/2011 acquitting the respondent, herein, from the offence punishable under Section 138 of the NI Act, 1881. The appeal has been instituted assailing the order of acquittal of the respondent, herein, by the learned Trial Court. Mr. K.R. Bora, learned counsel representing respondent No. 2, i.e. the accused in C.R. Case No. 23/2011, has submitted that the respondent No. 2 has passed on, on 29- 10-2025. Accordingly, the present appeal stands abated against the respondent No. 2 and accordingly, the same would have to be closed. In view of the above, the present appeal stands closed on being abated.
