ORAL ORDER
Accused in Cr.No.11/2025 registered by Hosahalli Police Station, Bengaluru, for offence punishable under Section 108 of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS') is before this Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (for short 'BNSS') seeking regular bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.11/2025 was registered by Hosahalli Police Station, Bengaluru for the aforesaid offence against the petitioner based on the first information dated 20.03.2025 submitted by Meghana G.S., daughter of deceased Gangathnamma. During the course of the investigation of the case, petitioner herein was arrested on 20.03.2025 and subsequently, remanded to judicial custody. His bail application is filed before the Jurisdictional Sessions Court in

Crl.Misc.No.10062/2025 was rejected on
09.04.2025. Therefore, the petitioner is before this Court.

Perusal of the material on record would go to show that deceased Gangarathnamma had committed suicide by hanging herself on 13.03.2025 and thereafter, a UDR case under Section 194 (3) of BNSS, 2023 was registered in UDR No.3/2025 by Hosahalli Police Station, Bangalore. In the first information it is alleged that the first informant was subsequently summoned to the police station and informed by the Sub-Inspector of Police that during the course of investigation in the UDR case, petitioner herein has admitted that he had illicit relationship with the deceased and after his wife came to know about the same, she had left his company and therefore, he had abused the deceased on 13.03.2025 and asked her to go and die. It is under these circumstances on 20.03.2025, the first informant had submitted a first information, based on which, FIR has been registered against the petitioner. Except the aforesaid, there is no other allegation found in the first information against the petitioner about he committing any such act, which would have abetted or instigated the deceased to commit suicide. The petitioner, who

has no other criminal antecedent is in custody from
20.03.2025. Major portion of the investigation is completed. Under such circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail is required to be answered affirmatively. Accordingly, the following:-
ORDER
The petition is allowed. The petitioner is directed to be enlarged on bail in Cr.No.11/2025 registered by Hosahalli Police Station, Bengaluru, for offence punishable under Section 108 of the BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
