The original amount was of Rs. 7,40,000/- along with the interest @ 7% from the date of filing of the claim, with equal liability on the two insurers. The original award had been satisfied and now this appeal has been settled for an additional amount of Rs. 3,00,000/- bringing the total liability on each of the insurers at Rs. 7,11,589/- out of which an amount of Rs. 5,61,589/- each has already been paid. Accordingly, on this settlement, each of the insurers namely, The New India Assurance Co. Ltd and the Oriental Insurance Co. Ltd shall deposit an amount of Rs. 1,50,000/- each respectively before the Registry of this Court within a period of 45 days from today in which event no further interest shall appear on this settlement amount. In the event, the deposit is not made within a period of 45 days, Statutory Interest shall apply. On the settled amount being deposited before the Registry, the same shall be released to the claimant on proper identification. The appeal is closed on settlement.
