JUSTICE PRANJAL DAS ORDER 18.12.2025 1. Heard Ms. N. S. Thakuria, learned counsel appearing for the accused petitioner as well as Mr. R. J. Baruah, learned Addl. P.P., Assam appearing for the State respondent. Page No.# 2/3 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Md. Baharul Islam, praying for grant of bail in connection with Palashbari P.S. Case No.266/2025 under Sections 143(3) BNS (GR Case No. 922(K)/2025). 3. The allegation in the FIR lodged by mother of the victim girl with the allegation that her daughter along with another minor girl was recovered from Barpeta area. During enquiry it was revealed that one Baharul Islam, a dance teacher made preparation to transport them to Bihar for participating in a dance competition on the occasion of Chhat Puja without obtaining the consent of their respective parents. 4. Investigation is completed in the case resulting in a charge-sheet. 5. In the statement of one of the victim girls as available in the scanned report, reveals implication against the petitioner. Though, the girls were interested in going for some dance program and the petitioner told them to go; the girls did not inform home and later, they came to know that he was taking them to Bihar for dancing programs wearing short dresses and where the participants would be throwing money in cash. 6. Nevertheless considering the length of detention and the fact that the case is poised for commencement of trial- the petitioner is allowed to go on bail of Rs.30,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the petitioners: (a) shall co-operate with the trial, if commenced. (b) Shall not hamper or tamper with the evidence Page No.# 3/3 (c) shall not harass, intimate or harm the victim in any manner. 8. Accordingly, this bail application stands allowed and disposed of.
