Respondent(s) (Cause Title is taken from Case Information System) Digitally signed by NADIM MOHLE -2- For Petitioner : Mr. Deepak Kumar Singh, Advocate For State : Mr. Vedant Shadangi, Panel Lawyer Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 14.07.2025 1) The petitioner has filed the present writ petition assailing the order dated 07.03.2017 passed by the respondent No.3/ District Collector, Janjgir-Champa, whereby a direction has been issued for recovery of an amount of 37,400/- on ₹ account of irregularities in distribution of school uniforms under the Sarva Shiksha Abhiyan. 2) Learned counsel for the petitioner submits that at the relevant point of time, the petitioner was posted as In-charge Headmaster at Janpad Primary School, Sukhapali, Block Dabhara, District Janjgir-Champa. He contends that under the Sarva Shiksha Abhiyan, free uniforms were to be distributed to the students of the school. However, due to certain irregularities in the process of distribution, an enquiry was conducted and on the basis of the said enquiry report, the Collector passed the impugned order of recovery dated 07.03.2017. He further submits that the petitioner has wrongly been held liable and thus, he prays for quashing of the order impugned. 3) On the other hand, learned State Counsel opposes the writ petition and submits that no specific order of recovery has been passed against the petitioner. He further submits that the order dated 07.03.2017 has been passed against the -3- concerned school, and not against any individual including the petitioner. It is submitted that on irregularities of distribution of school uniform, an inquiry was conducted and decision was taken; thus, the instant writ petition deserves to be dismissed. 4) From a perusal of the order dated 07.03.2017 (Annexure P/1), it is apparent that the recovery order has been issued against the Primary School, Sukhapali, and not against the petitioner in his personal capacity. 5) In view of the above, as no specific order of recovery has been passed against the petitioner, no interference is warranted in the present writ petition. 6) Accordingly, the writ petition is dismissed. 7) However, if the petitioner has made any representation in this regard, the competent authority is directed to consider and decide the same in objective manner, if already not decided.
