Roychoudhury, learned counsel appearing for the petitioners; Ms. P. Thapa, learned counsel representing Mr. S. Dutta, learned Standing Counsel, Panchayat & Page No.# 5/6 Rural Development Department for the respondent nos. 1 & 6; Ms. G. Hazarika, learned Standing Counsel, Revenue Department for the respondent no. 2; and Ms. M. Barman, learned Junior Government Advocate, Assam for the respondent nos. 3, 4 & 5. 2. The petitioners have preferred the instant writ petition seeking a direction for clearance of the lands of Padumpukhuri Grazing Reserve in terms of an Order dated 17.02.2015 passed by the Additional Deputy Commissioner, Nagaon by dismantling the structures constructed thereon. 3. Ms. Barman, learned Junior Government Advocate, Assam for the respondent nos. 3, 4 & 5 has placed a Communication bearing no. eCF. 35923/288 dated 18.11.2025 of the respondent no. 3, addressed to her, which is marked as Document ‘X’ and kept with the case record. 4. As per the instructions placed therein, an eviction drive was carried out at Padumpukhuri Grazing Reserve, covered by Dag no. 249, under Doboka Revenue Circle of Hojai Revenue Circle on 10.11.2025. During the eviction process, a total of 114 nos. of commercial establishments with RCC structures have been dismantled and an area of 31 Bighas out of 43 Bighas, 2 Kathas & 12 Lessas have been made free from encroachment. Eviction process in an area of 12 Bighas, 2 Kathas & 12 Lessas out of total 43 Bighas, 2 Kathas & 12 Lessas has not been carried out since the Government of Assam has approved an area measuring 10 Bighas, 2 Kathas & 12 Lessas for de-reservation and allotment in favour of Muktab School, Maszid, Burial Ground and Iddgah vide Letter no. RSG. 66/2000/35 dated 15.11.2000 which is under possession of the same institutions. Another area of land measuring 1 Bigha is under possession of Abdul Kadir who has filed an application for allotment of the said land vide Case no. W.P.[C.]/1132/2017. Therefore, eviction process was also not carried out therein. 5. In view of the above projections that an area of land 31 Bighas out of 43 Bighas, 2 Kathas & 12 Lessas have been made free of encroachment by dismantling a total of 114 nos. of establishments with RCC structures and for reasons assigned for not carrying out eviction drive in the remaining area, this writ petition is closed, as the relief sought for has been Page No.# 6/6 effectively redressed. However, if the petitioners have any further grievance with regard to the remaining areas which have not been made encroachment free for the reasons mentioned, the petitioners are at liberty to seek appropriate remedy as per law. 6. A copy of the Letter bearing no. eCF. 35923/288 dated 18.11.2025 and its enclosure are to be furnished to Mr. Roychoudhury, as requested, by Ms. Barman and also to be kept as part of the case record.
