Neutral Citation No. - 2025:AHC:35127 Court No. - 5 Case :- WRIT - A No. - 7497 of 2020 Petitioner :- Madhuri Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Jitendra Kumar Mishra Counsel for Respondent :- C.S.C.,Ram Bahadur Singh Hon'ble Ajay Bhanot,J.
1. The petitioner claims that her application for grant of appointment on compassionate grounds under Uttar Pradesh Recruitment of Dependents of Government Servants Dying in Harness Rules, 1974 is not being decided till date.
2. Heard Shri Jitendra Kumar Mishra, learned counsel for the petitioner, learned Standing Counsel for the State-respondent No. 1 and Shri Ram Bahadur Singh,
learned counsel for the respondent No. 2.
3. The father of the petitioner died in the year 2011. The petitioner made an application for grant of appointment under compassionate ground in the year 2020.
4. Admittedly at the time of death of her father, the mother of the petitioner was also in service and working on the post of safai karamchari in Nagar Palika Parishad, Shahjahanpur.
5. The petitioner is not entitled to appointment on compassionate grounds for various reasons. The family did not face financial distress on account of her father's death. Secondly the petitioner has approached this
Court after a delay of almost nine years. The delay on part of the petitioner in matters of compassionate appointment gives rise to the inference that the financial destitution suffered by the claimant at the death of the deceased has ceased to exist.
6. Further there is another aspect to the controversy. There is no satisfactory explanation for the delay and laches on part of the petitioner. The writ petition is liable to be dismissed on ground of delay and laches.
7. The writ petition is dismissed.
