2. This is an application filed under Section 482 of BNSS, 2023, by the petitioners, as NBWA has been issued against him after charge-sheet has been filed in the case showing him as an absconder. It is stated that the petitioners, the informant and all other persons who knew about the incident were under the impression that since marriage between the petitioner No-1 and missing girl as per the FIR i.e. the petitioner No-2 herein was solemnized and due information was given about the marriage to the police by the informant mother herself so the case was thought to be settled or closed accordingly.
3. It is further submitted that the petitioner No.1 against whom the NBWA has been issued was not aware of the passing of the order passed by the learned trial Court at Majuli, as they were residing in West Bengal.
4. Having regard to the above, it is provided that the petitioner No.1, shall appear before the learned trial Court within a period of fifteen days from today and file appropriate application for bail which shall be considered by the learned Court as per law. In the meantime, NBWA issued against the petitioner shall be kept in abeyance.
5. Accordingly, this petition stands disposed of.
