Heard Mr. HR Choudhury, the learned counsel appearing for the petitioner as well as Mr. P.S. Lahkar, the learned Additional Public Prosecutor for the state of Assam.
2. This is an application under Section 528 of the BNSS, 2023 in respect of Special NDPS Case No.10/2022 arising out of Dholai P.S. Case No. 27/2021 pending in the Court of the learned Special Judge, Cachar, Silchar.

3. The petitioner has been shown as an absconder in the charge-sheet.
4. The learned counsel for the petitioner submits that the petitioner is interested in facing the trial. Therefore, he prays that he should be given one opportunity to appear before the trial court to contest the case.
5. Mr. Lahkar has submitted that he has objection to the prayer for bail on the ground that the commercial quantity of narcotic drugs has been recovered in the instant case.
6. I have considered the submissions made by the learned counsel of both sides.
7. Since the petitioner is interested in facing the trial, this Court is of the opinion that he should be given an opportunity to contest the case. 8 It is hereby directed that the petitioner Amad Uddin Tapadar shall appear before the Court of the learned Sessions Judge/Special Judge, Cachar, Silchar in connection with Special NDPS Case No.10/2022 within next 10 days from today. On his appearance, the petitioner Amad Uddin Tapadar shall be released on bail of ₹50,000/- with a surety of like amount to the satisfaction of learned Special Judge, Cachar, Silchar. The warrant of arrest, if any, issued against the petitioner shall be recalled. With the aforesaid direction, the present criminal petition. JUDGE Comparing Assistant
