1. As per the status report filed on behalf of Municipal Corporation of Delhi (‘MCD’), it is stated that as per record, one tehbazaari site has been allotted to petitioner at 1/10 opposite C-107, Naraina Industrial Area, Phase 1, adjoining the wall of the park vide letter dated 5th September 2001, against which petitioner has also deposited tehbazaari fees, and petitioner was free to carry out his vending activity from the said allotted tehbazaari site.
2. Mr. Virdi, counsel for the MCD further states that petitioner has no right to carry out vending activities at any place other than what has been allotted to him. The sites which have been claimed by petitioner for vending, i.e. opposite Jhelum Jewellers, School Wali Diwar, Gharlian Singh Road, Karol Bagh and later at Ajmal Khan Road near Guru Harkishan Public School, Karol Bagh, are not the allotted sites. The affidavit further states that the area around Karol This is a digitally signed order. Bagh and the whole Ajmal Khan Road have been declared as ‘no squatting / no hawking zone’ and any attempt to carry out vending activities in these zones will amount to illegal squatting.
3. Statement of Ms. Virdi is taken on record, aside from what is stated in the status report of the MCD.
4. Mr. Chaudhary, therefore, does not wish to press his petition and states that petitioner will file a representation for allocation of another site as opposed to what had been allotted to them.
5. In the event such representation is filed, the MCD shall consider the same in accordance with law.
6. The petition is therefore disposed of in above terms.
