This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with Barhi (Padma O.P.) P.S. Case No.351 of 2023, for offences under Sections 354(A), 354(B), 504, 506 IPC and Section 8 of the POCSO Act. The case is presently pending before the Court of learned Additional Sessions Judge-III-cum-Special Judge, POCSO Act, Hazaribag.

Learned A.P.P. representing the opposite party - State opposes the anticipatory bail application.

From the F.I.R., I find that there is allegation that this petitioner who happens to be the relative of the victim has entered into her room and inappropriately touched her who is aged about 16 years.

Considering the nature of allegation, I am not inclined to enlarge this petitioner on anticipatory bail.

Accordingly, this Anticipatory Bail Application stands dismissed.

The petitioner is directed to surrender before the learned Court below.
