The petitioner is the plaintiff in the suit. He filed suit in OS No. 15 of 2005, to declare the registered sale deed dated 29.01.2005 executed by the 1®* defendant in favour of defendants No.2 to 8 in respect of the plaint schedule property, as null and void and not binding on the plaintiff. Pending the suit, the petitioner filed 2. l.A.No.705 of 2010 under Section 45 of the Evidence Act to send Ex.B.2 to the handwriting expert and Fingerprint Bureau for examination. The said application was allowed by order dated 20.10.2010 directing the petitioner/plaintiff to furnish documents containing the admitted signatures. Despite the said order the petitioner did not choose to submit the documents containing the admitted signatures. Thereafter, the trial court proceeded with the suit and when it is posted for arguments, the petitioner filed l.A.No.844 of 2022 to reopen the suit so as to take steps to send the admitted signatures as per the order dated 20.10.2010 passed in l.A.No.705 of 2010. The said application was dismissed by the order impugned in the present revision. 3. s. / 5 TCDSJ C.R.P.No.l967of2023 On perusal of the record, it is clear that, though the application vide lA No.705 of 2010 was allowed by order dated 20.10.2010, for the reasons best known to the petitioner, it did not take steps to furnish documents containing admitted signatures. Further, after twelve long years from the date of the order, especially when the matter is posted for arguments in the suit, the present application is filed seeking to reopen the suit. It is pertinent to note even along with the present application, the petitioner failed to furnish the documents containing the admitted signatures. In the absence of the admitted signatures, no purpose would be served even if the suit is reopened. 4. 5. Having considered the submissions made by the counsel on either side, this Court is not inclined to interfere with the order passed by the trial court. In view of the same, the revision petition is dismissed. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
