This application has been preferred by the petitioner for modification of the order dated 25.04.2016 passed in A.B.A. No. 3360 of
2015. The modification which has been sought for is with respect to extending the period of surrender of the petitioner as it has been submitted that the petitioner has not been informed by his pervikar of the said case and ultimately when the Chowkidaar of the village has informed him on 12.06.2022 that a warrant of arrest has been issued against him, he has come to know about the existence of the order dated 25.04.2016 passed in A.B.A. No. 3360 of 2015 and consequently has filed the instant application.
As has been noted above that the petitioner had been granted anticipatory bail on 25.04.2016 and this application for modification seeking extension of the period for surrender has been filed on 23.08.2022 which is after almost 6 years and 4 months after the order was passed. A feeble explanation has been submitted by the petitioner in this application which is not acceptable in court and therefore, I am not incline to accede to the prayer made in this application and consequently this application stands dismissed.
