HIGH COURT OF UTTARAKHAND AT NAINITAL Writ Petition No. 466 of 2025 (M/S) Smt. Sumitra Kaur ….......Petitioner Vs. State of Uttarakhand and another …..... Respondents Present : Mr. Vikas Kumar Guglani, Advocate for the petitioner. Mr. Mahendra Singh Bisht, Brief Holder for the State/respondents. JUDGMENT Hon’ble Ravindra Maithani, J. (Oral) The challenge in this writ petition is made to an order dated 18.07.2024, passed by respondent no.2, District Magistrate, Udham Singh Nagar, by which, the arms license has been denied to the petitioner. 2. Heard learned counsel for the parties and perused the record. 3. At the very outset, the Court wanted to know, as to why the appeal has not been filed under Section 18 of the Arms Act, 1959? 4. Learned counsel for the petitioner would submit that pursuant to the earlier writ petition the matter was processed by the respondent no.2, but the license has been denied. 5. Section 18 of the Arms Act, 1959 prescribed the right for appeal, by which, any person aggrieved by 2 the order for the licensing authority refusing to grant a licence may prefer an appeal. Therefore, there is no reason to entertain the instant petition. Accordingly, the petition deserves to be dismissed at the stage of admission itself. 6. The petition is dismissed in limine.
