(ORAL) FIR No. Dated Police Sta0on Sec0ons 189 19.09.2023 Sadar Ludhiana, District Ludhiana 328, 457, 381, 411, 34 IPC The peoner incarcerated in the FIR caponed above, has come up third me before this Court under Secon 483 BNSS, 2023 seeking regular bail.
2. Custody cerficate dated 06.07.2025 filed by State counsel today in the Court is taken on record.
3. Counsel for the State opposes the bail on the ground that the peoner hails from Nepal and in case, this Court grants him bail it shall be extremely difficult for the State to secure his presence and produce him before the trial Court.
4. A8er arguing at length, counsel for the peoner submits that he would be sasfied if trial Court is directed to decide the trial in a me bound manner.
5. This Court is well aware that in cases the accused persons, who hail from other countries and are involved in heinous offences, it becomes extremely difficult to procure their presence. This is an exceponal situaon. Peoner’s custody is already more than 01 year and 09 months and strangely, the trial Court did not take any steps to expedite the trial. Given above, the present peon is disposed of with a direcon to the trial Court to expedite the trial and make efforts to decide the same on or before 30.10.2025 and take up this case on top most priority. It is clarified that the State shall not seek any adjournment and shall ensure that all the witnesses are served as per the direcon of the trial Court. If any lapse is done by the State in service of the witnesses or if the State seeks any adjournment, the concerned Court shall inmate to the concerned Senior Superintendent of Police in this regard, who shall take appropriate acon against the defaulng officials/office. It is further clarified that the period for which the peoner- accused seeks adjournment, equal me shall stand extended automacally in the given period i.e. 30.10.2025. All pending miscellaneous applicaons, if any, stand disposed of.
