This is an application under Section 482 of the Bharatiya Nagarik Suraksha Page No.# 2/3 Sanhita (BNSS), 2023 praying for granting of bail to the accused applicant, namely, Nurul Azim @ Nurul Ajim in connection with Mankachar P.S. Case No. 129/2025 (GR No. 302/2025) under Sections-126(2)/ 117(2)/118(2)/ 109 of the Bharatiya Nyaya Sanhita (BNS), 2023. 3. The allegations against the petitioner is that on 02.09.2025, at about 7.00 P.M. while the present petitioner was sitting on a culvert near the Jewali Lower Primary School, the informant and his accomplices, viz. 1. Awower Hussain, 2. Foridul Islam, 3. Jahanuddin, 4. Jaidul Islam, 5. Mashidur Islam, 6. Hasen Ali, and 7. Raju Sk as per their prior conspiracy and enmity suddenly came, armed with deadly weapons and assaulted the petitioner mercilessly, causing grievous injuries to his body, viz. left wrist, right arm and chest. The petitioner's wife along with other co-villagers on reaching at the place of occurrence after hearing hue and cry, the accused persons fled away by threatening dire consequences. The petitioner was attacked with the intention to cause death. As a result, the petitioner was brought to the Hatsingimari Civil Hospital for medical treatment. 4. The learned counsel for the petitioner submits that the petitioner has being falsely implicated and it is the petitioner side which has been injured in the attack made by the informant side in respect of which the petitioner side had also lodged an FIR which is annexed at Pg. 19 of the instant petition. It also appears that the petitioner No. 1 also sustained injuries as reflected in the Annexure 4 medical report. 5. It further appears that the other three co-accused has already been granted pre-arrest bail by the learned Sessions Judge, South Salmara Mankachar by order dated 14.10.2025 in Misc. (Criminal) Case No. 158/2025 Page No.# 3/3 and Misc. (Criminal) Case No. 177/2025 after perusal of the CD and coming to the conclusion that the investigation of the case has sufficiently progressed and the victim and the prime witnesses have already been examined. 8. Considering the above, the prayer for pre-arrest bail in respect of the present petitioner is allowed. 9. The petitioner abovenamed shall be released on pre-arrest bail of Rs. 40,000/- with one surety of like amount to the satisfaction of the arrested authority of the said case subject to the following conditions: 1. The accused petitioner shall appear the I.O. as and when required. 2. The accused petitioner shall co-operate with the investigation. 3. The accused petitioner will not leave the jurisdiction of the Court and 4. The accused petitioner will not induce, threaten anybody who is acquainted with the present case. 10.
