Heard Mr. M. Saikia, learned counsel for the petitioners. Also heard Mr. D.P. Goswami, learned Addl. P.P. appearing for the State respondent. 2. This application under Section 483 of BNSS, 2023 has been filed by the accused/petitioners, namely, Nibhash Pegu @ Nivash Pegu, Niten Patir @ Nitin Patir and Kulu Patir @ Kula Patir, praying for grant of bail in connection with Jonai P.S. Case No.90/2025, under Section 70(1) of BNS, 2023. 3. Mr. D.P. Goswami, learned Additional P.P. submits that in the meantime the concerned P.S. Case i.e. Jonai P.S. Case No.90/2025, under Section 70(1) of BNS, 2023 case has been charge-sheeted. The 3(three) petitioners, herein, are seeking bail and they were arrested on 23.10.2025. 4. The allegation in the FIR was about snatching of money from the victim and commission of rape upon her. The learned counsel for the petitioner has submitted the copies of the statement of the victim recorded under 183 BNSS and contending that it is the copy which has been furnished to them under Section 230 BNSS. The said statement is also perused by the learned prosecution. In the said statement, the informant/victim has stated that Rs. 15,000/-was snatched away from her by the petitioners and she has stated at the end of the statement, at that time she was angry and therefore, she also stated that these persons have raped her. 5. In view of the aforesaid facts and circumstances and also the length of detention as well as the completion of investigation –the accused person is hereby allowed to go on bail of Rs.
25,000/- each with one surety of like amount each to the satisfaction of the learned concerned Court and subject to the following conditions that:- (i) That the accused persons shall be available for trial, if one commences, (ii) That the accused persons shall not hamper or tamper with evidence. (iii) That the accused persons shall not in any manner intimidate harass or harm the informant and his family members. 6. Violation of any bail conditions will entail cancellation of the bail. 7.
