ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:-
“….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declare the inaction on part of the respondents herein not releasing the final bills amount worth of total an amount of Rs.16,37,810/- Agreement No.17/2023-24, dated 19.06.2023 and D.R.No.40/2023-24, dated 24.05.2023 with interest of execution of completion of O&M works under Irrigation Department as per agreement to the petitioner till today and causing heavy loss with interest even though total work was completed as per the agreement as illegal, arbitrary and violative of Articles 14, 16 and 21 of the Constitution of India and consequentially to direct the respondents releasing the final bill of total amount worth of Rs.16,37,810/- for execution of completion of Irrigation works under Irrigation Department as per agreement to the petitioner forthwith….”
2. The petitioner has executed the works in the Irrigation and Water resources, Panchayat Raj and R&B Departments. The Government has administratively sanctioned the works in favour of the petitioner for an estimated amount of Rs.16,37,810/- vide Agreement No.17/2023-24, dated 19.06.2023. Upon completion of the said works, the respondents prepared a final bill for an amount of Rs.16,44,327/-. However, as the payment of the said amount has not been made by the respondents, the petitioner has approached this Court and filed the present writ petition. 5 VS,J W.P.No.17258 of 2025
3. It is the contention of the petitioner that even though the respondents admitted that the petitioner is entitled for payment of the aforesaid amount, no payment is being made. 4. Heard learned counsel for the petitioner as well as learned Government Pleader for Irrigation. 5. The learned Government Pleader for Irrigation, on instructions, has admitted the final bill amount payable to the petitioner and has requested this Court to fix a period of two (2) months for payment of the said amount to the petitioner. 6.
In view of the submission made by the learned Government Pleader for Irrigation, the Writ Petition is disposed of by directing the respondents to release the final bill amount of Rs.16,44,327/- to the petitioner within a period of two (2) months from the date of receipt of a copy of this order. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, in this Writ Petition, shall stand closed. ___________________ JUSTICE V.SUJATHA Date: 04.08.2025 KGR
