The learned High Court Government Pleader accepts notice for respondent No.1. 2. Sri S. Satish Kumar, learned counsel, undertakes to file vakalatnama on behalf of respondent No.2. 3. The petitioner, who has been charge-sheeted for offences punishable under Section 66E of the Information Technology Act, 2000, and Sections 354A and 506 of the Indian Penal Code, 1860, is before this Court seeking relief. 4. The prosecution alleges that the accused hacked the mobile phone of the de facto complainant, retrieved contacts, photos, and videos, and threatened the de facto complainant to part with money, failing which the accused would circulate the pictures and videos. - 3 - NC: 2025:KHC:17363 CRL.P No. 5879 of 2025 5. The parties are present before this Court and have filed a joint affidavit stating that they have amicably resolved the dispute among themselves. In terms of the settlement, respondent No.2 has agreed to withdraw all allegations against the petitioner and has no objection to the quashing of the impugned proceedings. It is further stated that the prosecution of the matter is affecting their personal and professional lives, leading to various health issues, anxiety, and financial difficulties, and that quashing the proceedings would help maintain a cordial relationship and prevent further hostility. 6. The joint affidavit is placed on record. 7. Although the offences alleged are cognizable and non- compoundable, considering the amicable resolution between the parties, subjecting the petitioner to trial would serve no purpose. The likelihood of conviction is remote and bleak in light of the settlement. Therefore, continuing criminal proceedings against the petitioner would amount to an abuse of the legal process. ORDER i. Accordingly, the petition is allowed. ii. The impugned proceedings in C.C.No.11893/2025 on the file of ACJM, Bangalore Rural is hereby quashed. - 4 - NC: 2025:KHC:17363 CRL.P No. 5879 of 2025 iii. It is needless to state that the respondent No.2 is entitle for release of the mobile phone which was seized in crime No.296/2024 registered by Whitefield Police Station.
