B/1096/2023 dated 19-1-2024 of the 4th Respondent for deleting the land to an extent of Ac.0-10 Cts in Sy.No. 151/13 in Kothapalem Village, Renigunta Mandal, Tirupati District, from the list of prohibited properties under Section 22A of the Registration Act, and to rectify the Web land Adangal, as arbitrary, illegal, in violation of Article 14, 21 and 300A of the Constitution of India and also in violation of the law laid down by this Honble Court, and consequently direct the Respondents, in particular the Respondents 2 and 3 to delete the land to an extent of Ac.0-10 Cts in Sy.No.151/13 in Kothapalem Village, Renigunta Mandal, Tirupati District, from the list of prohibited properties under Section 22A of the Registration Act by rectifying in the Web land Adangal as Patta Land, and to pass such IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents 2 and 3 to consider the reports submitted by the Respondents 4 and 5 vide Roc. GP FOR REVENUE The Court made the following ORDER: Heard Sri R Chandra Reddy, learned counsel for the petitioner and Sri Divya Theja, learned Assistant Government Pleader for Revenue for the respondents. 2. The petitioner made an application to the Tahsildar to delete an extent of Ac.0-10 cents in Sy.No.151/13 in Kothapalem village, Renigunta Mandal, Tirupati District from the list of prohibited properties under Section 22A of the 3 Registration Act, 1908. However, the respondent authorities have failed to take any action on the petitioner’s application. 3. The petitioner asserted title to the property by inheritance. The Tahsildar-5th respondent addressed a letter vide Roc.A/459/2023 dated -12- 2023 (Ex.P.1) recommending to delete the petitioner’s property from the prohibited properties list after changing the classification from the Government land to patta land. The Revenue Divisional Officer, Srikalahasti, addressed a letter to the District Collector vide Roc.B/1096/2023, dated 19.01.2024 (Ex.P.2) recommending to delete the properties from the prohibited properties list. The Tahsildar of Renigunta Mandal addressed a letter to the Joint Collector of Tirupati, vide Roc.No.A/289/2024, dated 21.06.2024, requesting permission from the authority to make a suo-moto online webland correction. The Tahsildar also issued an endorsement dated 04.11.2024 stating that after passing of orders by the Joint Collector, Tirupati, the petitioner’s grievance will be resolved. 4. The petitioner made another representation to the 2nd respondent- Collector dated 19.05.2025 and 09.06.2025. The District Collector, in turn, vide proceedings F1/397/2025 dated 17.06.2025, directed the Tahsildar to examine the issue and send a detailed report immediately. 5. Learned counsel for the petitioner would submit that, in fact, the Tahsildar and the Revenue Divisional Officer submitted reports vide Exs.P.1 and P.2. 6. Learned AGP would submit that the Tahsildar will submit a report within four (4) weeks. 7. Given the facts and circumstances of the case, the writ petition is disposed of at the admission stage directing the 5th respondent-Tahsildar to submit report to the District Collector concerning Exs.P.1 to P.4. Thereafter, the 2nd respondent shall pass appropriate orders, strictly as per law within four 4 (4) weeks regarding claim made by the petitioner keeping in view Ex.P.1 report. No order as to costs.
