1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 94 of 2025 registered at Police Station – Kosir, District Sarangarh-Bilaigarh (C.G.) for the offences punishable under Sections 318(4), 316(5) and 3(5) of the BNS, 2023.
2. Prosecution case, in brief, is that on instructions of the Collector a five member enquiry team has been constituted and a physical verification of the RAVI SHANKAR MANDAVI Digitally signed by RAVI SHANKAR MANDAVI Date: 2025.05.28 18:11:30 +0530
2 Paddy Procurement Center Kosir has been done and it is found that there is shortage of 3,043.22 Quintal paddy amounting to Rs.94,33,000/- and in the enquiry further it is reveal that the computer operator has made the forge entry of the paddy though the said paddy was not purchase in the procurement center therefore the report is lodged at Police Station – Kosir, District Sarangarh- Bilaigarh (C.G.) and arrested the applicant.

Learned counsel for the applicant would submit that the applicant is innocent and he has been falsely implicated in offence in question. He further submits that the applicant was appointed as Bardana Prabhari in a salary of Rs.7,000/- per month only for the present procurement session and its the computer operator who has made the forge entry of the paddy though the said paddy was not purchase in the procurement center thereby the report against the 4 accused persons were lodged at Police Station – Kosir, District Sarangarh-Bilaigarh (C.G.) and also arrested the applicant. He also submitted that the applicant is not having any criminal antecedent registered against him, therefore, he prays to enlarge the applicant on anticipatory bail.
4. On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicant. He further submits that there is involvement of 3 more persons in the crime in question, therefore, he is not entitled for grant of anticipatory bail.
5. I have heard learned counsel for the parties and perused the material available on record.

Considering the facts & circumstances of the case, allegations levelled against the applicant that there was shortage of 3,043.22 quintal paddy amounting to Rs. 94,33,000/- and forge entry was made and further the fact that the applicant along with other co-accused were found involved in the crime in question out of which only one has been granted anticipatory bail from this Court
3 on a different footing whereas anticipatory bail applications of other two co- accused were rejected by this Court, thus, I am not inclined to grant anticipatory bail to the applicant.

Accordingly, the anticipatory bail application filed on behalf of the applicant - Shyam Jangde, under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 in Crime No. 94 of 2025 registered at Police Station – Kosir, District Sarangarh-Bilaigarh (C.G.) for the offences punishable under Sections 318(4), 316(5) and 3(5) of the BNS, 2023, is rejected. - Sd/-
