The present contempt application has been filed pleading willful disobedience of the order dated 24.2.2023 passed by this Court in S.C.C.Revision No. 20 of 2023. It is claimed by the applicant that the opposites parties have not yet deposited the decreetal amount and are not depositing the rent as determined by the trial court in its judgment dated 1.12.2022. The aforesaid condition prescribed in the order dated 24.2.2023 is a condition precedent for staying the execution of the order passed by the Courts below. On failure of the opposite parties to comply with the condition precedent, the applicant has the liberty and the concerned court is empowered to proceed with the execution of the decree. It is not a case for registering proceedings under the Contempt of Courts Act, 1971, The application is disposed of.
