The applicant has preferred this First bail application under Section 483 of BNSS for grant of regular bail as he is arrested in connection with Crime No.16/2020, registered at Police Station – Shyang, District Korba (C.G.) for the offence punishable under Sections 420, 467, 468, 471, 120-B/34 of IPC. 2. As per the prosecution story, complainant Bhupendra Singh Markam 2 made a complaint at police station Shyang, Korba, alleging that present applicant along with co-accused namely Shyam Singh Rajput sold the government land bearing Khasra No.343/1 and 349 ad- measuring 2.189 hectare and 0.955 hectare situated at Village Chiraa, and Khasra No. 175 admeasuring 1.011 hectare situated at Village Solwa by hacking the Patwari login ID. On the basis of complaint made by the complainant, the police registered the offence against the applicant and other co-accused persons. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. He further submits that it is very difficult to hack the Patwari Login ID and just to save the Patwari, the entire allegation attributed to the applicant and other co-accused persons, while prima facie, no case is made out against the applicant for commission of the alleged offence. He again added that another similarly situated co-accused person namely Moh. Akram Siddiqui has been extended benefit of anticipatory bail by this Court’s orders dated 25.06.2021 in MCRCA Nos. 332 of 2021 and 350 of 2021 & co-accused person namely Shyam Singh Rajput has been granted bail by this Court vide order dated 20.09.2021 in MCRC No. 6814/2021. He next added that the applicant is in jail since 22.04.2025 and conclusion of the trial is likely to take some time. Therefore, the present applicant may also be granted privilege of regular bail. 4. On the other hand, learned counsel for the State opposes the bail application and submits that the main allegation is against the present applicant, therefore, no case is made out to release the applicant on bail. 3 5. I have heard learned counsel for the parties and perused the material available on record. 6. Having considered the orders dated 25.06.2021 and 20.09.2021 passed by this Court in MCRCA Nos. 332 of 2021 and 350 of 2021 & MCRC No. 6814 of 2021 respectively; looking to the allegation against the present applicant; detention period and that conclusion of the trial is likely to take some time, without commenting anything on merits of the case, this Court is inclined to release him on regular bail. 7. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court for his appearance before the said Court as and when directed, till disposal of the trial.
