1. Heard Mr. A Rahman, learned counsel for the petitioner; Ms. N Bordoloi, learned Standing Counsel, Revenue Department for respondent No.1; and Mr. J Handique, learned Junior Government Advocate for respondent Nos. 2 &3. 2. The case projected by the petitioner is that he is the owner and in possession of a plot of land measuring 2 Bighas [2B-OK-OL], covered by Dag No.642 [Old]/111 [New] and Periodic Patta No.34, situated at Durahati, Dhubri Revenue Circle, District - Dhubri [“the subject-plot”, for short]. 3. The petitioner has stated that his name has been recorded in the Manual Draft Chitha of the land prepared on 18.06.1993. But, at the time of uploading the name of the pattadars against the parcels of land under Periodic Patta No. 34 which has a total land area of 14 Bigha, 2 Katha and 4 Lechas, the petitioner’s name has been dropped. As a result, the petitioner is finding difficulty to deposit the land revenue through the Online Portal. 4. The petitioner stated that stating his grievances, he submitted two Representations on 28.03.2025 and 24.07.2025, receipt of which were duly been acknowledged by the officer of the respondent Nos. 2 & 3 respectively. As the Representations submitted by the petitioner have not been given any consideration till date, the petitioner is before this court by the instant writ petition. Page No.# 3/4
5. Mr. Handique, learned Senior Government Advocate has submitted that if the petitioner’s Representation’s stated to have been submitted on 28.03.2025 and 24.07.2025, are still pending, this writ petition can be disposed of with a direction to the said respondents to consider and dispose of the Representation dated 24.07.2025 on merits within a reasonable period of time.
It is submitted by him that period of one month will be a reasonable period for disposal of the Representation, if the same has not yet been disposed of. 6. Mr. Rahman, learned counsel for the petitioner has agreed to the said submission of Mr. Handique. 7. In view of the broad consensus arrived at by the learned counsel for the parties in the afore-stated manner and considering the limited nature of grievance raised by the petitioner in the Representation dated 24.07.2025, receipt of which was acknowledged by his office, this court is of the view that instead of keeping this writ petition pending, the same can be disposed of with a direction to the respondent No. 2 to consider and dispose of the representation dated 24.07.2025 within a period of one month from the date of submission of certified copy of this order along with a copy of the writ petition with annexures by the petitioner at his office. If the respondent No.2 finds that the Representation dated 28.03.2025 is to be considered and disposed of by the respondent No.3, then he shall forward the Representation to the respondent No.3 for consideration and disposal within the same period. It is ordered accordingly. 8. It is further observed that the respondent No.2/3 shall
