Also heard Ms. N Das, learned Additional Public Prosecutor. 2. This is an application under Section 483 of the BNSS, 2023 for release the accused/petitioner, namely; Sopial Hoque @ Sofiul, on bail who was taken into custody on his appearance before the Ld. CJM, Dhubri on 02.09.2025 in Page No.# 2/2 connection with PRC Case No. 457/2025, arising out of Golakganj P.S Case No. 48/2025 registered under Section 61(2)/117(4)/109/103(2)/3(5) BNS. 3. That the accused/petitioner begs to state that on 23-02-2025 one Jotshna Barman lodged an FIR before the officer-in-charge of Golakganj police station alleging inter alia that, on last 20-02-2025 at about 4 AM while her husband was proceeding from Birat Nagar Chariali towards Dakshin Tokrerchora Pt-IV to the house of niece, a team of miscreants entering into a criminal conspiracy wrongfully confined him and tied on a tree and assaulted him, attempting to kill him and caused grievous injuries on his person. Thereafter the police party recovered him and brought to the Glakganj BPHC and seeing the critical condition he was referred to the DMCH, Dhubri and thereafter referred to the GMCH. After having received the said FIR the O/C, Golakganj Police Station registered a case vide Golakganj P. S. Case No-48/2025 registered under Section-61(2)/117(4)/109/103(2)/3(5) of BNS, 2023. 4. On perusal of the CD, it appears that the eyewitnesses have clearly implicated the petitioner as submitted by the learned Additional Public Prosecutor. 5. Having regard to the gravity of the offence and the materials available in the CD, a prayer for bail is rejected. 6. Accordingly, the bail petition stands dismissed at this stage.
