BEFORE HONOURABLE MR. JUSTICE MANISH CHOUDHURY ORDER Date : 19-11-2025 Heard Mr. K. Mira, learned counsel for the petitioners; Ms. K. Phukan, learned Central Government Counsel for the respondent nos. 1 & 2; Ms. P. Seyie, learned Standing Counsel, Social Justice and Empowerment Department for the respondent no. 3. 2. The Ministry of Social Justice & Empowerment, Department of Social Justice & Empowerment [Drug Prevention Division], Government of India issued a Notification dated 27.05.2025 inviting expression of interest cum proposal from eligible organizations for setting up of District De-Addition Centres [DDACs] under the National Action Plan for Drug Demand Reduction [NAPDDR] in 296 GAP districts across the country. In the Notification dated 27.05.2025, the district of Hailakandi figured at Serial no. 36 as one of the 296 GAP districts where District De-Addition Centre was proposed to be set up. The petitioner, an NGO, intended to participate in the said selection process for setting up of District De-Addition Centres [DDACs] in Hailakandi district. But when they tried to submit their proposal online, they could not file the proposal as the project was not available for Hailakandi district. 3. In such situation, the petitioner NGO approached this Court by the instant
Page No.# 3/3 writ petition. On 03.11.2025, the learned CGC was asked to obtain instruction whether Hailakandi district is one of the GAP districts where the proposal for setting up District De-Addition Centre is being contemplated. 4. Ms.
Phukan, learned CGC has placed a Corrigendum dated 29.05.2025 of the Ministry of Social Justice & Empowerment, Department of Social Justice & Empowerment, Government of India which was issued in partial modification of the previous Notification dated 27.05.2025. By the Corrigendum, the district of Hailakandi has been deleted from the list of GAP Districts. 5. In the instruction placed, it is mentioned that the selection eligibility criteria under the NAPDDR Scheme has provided that the districts already having any facility funded under the NAPDDR programme do not qualify as GAP Districts and therefore, are not eligible for sanction of a DDAC. As Hailakandi district has the presence of an existing Ministry supportive facility, it does not qualify as a GAP district and accordingly, it has not been classified as a GAP District. For such reason, Hailakandi district has been removed from the list of GAP Districts vide the Corrigendum dated 29.05.2025. 6. In view of such fact situation, there is no cause of action surviving for the petitioner to pursue the writ petition. 7. The writ petition is accordingly closed. JUDGE Comparing Assistant
