This application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) has been filed by the petitioner, namely, Pallabi Saikia, who is apprehending her arrest in connection with Nagaon P.S. Case No. 796/2025, under Sections 61(2)/316(5) of the BNS, 2023. 3. The gist of accusation in this case is that on 08.10.2025, the Additional District Commissioner (Education), Nagaon had lodged an FIR before the Senior Superintendent of Police Station, Nagaon making allegations of corruption and malpractice against the present petitioner, in the recruitment process of the education volunteers under Laokhowa Education Block. 4. It has been alleged that prior to lodging of the FIR, one Jakaria Ali Ahmed had made a complaint against the present petitioner before the Executing Director of Samagra Shiksha Mission, Assam, inter alia, alleging that the petitioner through her close associates collected Rs. 10,000/- from the said Jakaria Ali Ahmed, who was appointed as Education Volunteer in the year 2024-

The learned counsel for the petitioner has submitted that the allegations made by the complainant Jakaria All Ahmed in his complaint dated 04.08.2025, against the present petitioner is not true. 6. He submits that the petitioner is in no way involved in the recruitment process of the education volunteers. 7. He submits that the process of selection of educational volunteers are
Page No.# 3/4 given in the letter dated 26.09.2024, by the Additional District Commissioner- cum-District Mission Co-ordinator, SSA, Nagaon to the Block Mission Co- ordinators of various educational Blocks and as per the said guidelines, no role is there of the petitioner, who is presently engaged on contract basis as the DQM (Special Training). 8.
Vide Order dated 10.11.2025, the petitioner was granted interim bail and was directed to appear before the I.O within a period of 7 days from the date of the order. It is submitted on behalf of the petitioner that accordingly the petitioner has appeared before the I.O and his statement was recorded. 9. The learned Additional Public Prosecutor submits that in the meantime, the chargesheet has also been submitted. 10. Having regard to the nature of the allegation and the fact that the investigation of the case is completed wherein the petitioner has co-operated, it may not be necessary to take the petitioner into custody for the purpose of the trial if one commences. Accordingly, the order of prayer of interim bail dated 10.11.2025 is hereby made absolute upon the following conditions:- (1) The petitioner shall co-operate at the trial. (2) the petitioner shall not directly or indirectly make any inducement, threat or promise to the informant or to any other person who may be acquainted with the facts of the case so as to dissuade such person from disclosing such facts before the Investigating Officer or to any Court.
