Earlier prayer for bail of the petitioner was rejected on merit twice vide order dated 02.03.2023 passed in B.A. No.631 of 2023 and vide order dated 13.10.2023 passed in B.A. No.8802 of 2023. Petitioner above-named who is in custody since 24.09.2022 has renewed his prayer for regular bail in connection with Godda (T) P.S. Case No.260 of 2022 (Special POCSO Case No.84 of 2022) registered under Sections 147, 148, 149, 341, 342, 323, 325, 307, 302, 504, 506 of the Indian Penal Code and under Section 12 of the POCSO Act. Heard the parties. It is submitted by learned counsel for the petitioner that petitioner has renewed his prayer for regular bail on the ground that out of sixteen witnesses, ten have already been examined, but none of them has named the petitioner in the alleged offence. Learned APP for the State has vehemently opposed the prayer. This Court is of the view that the trial is in progress and appears to be at its penultimate stage and further there is no fresh ground for reconsideration of prayer of bail, as such, the same is again rejected.
