By way of instant petition, the petitioner has prayed for following substantive reliefs:-
“i). That this Hon’ble Court may be pleased to issue the Writ in the nature of mandamus or any other appropriate writ order or direction, directing all the respondents, more specifically respondent No.4 to sanction and release the pensionary benefits in favour of the petitioner under CCS (Pension) Rules 1972, as the case of the petitioner has been duly

forwarded by the respondent department to the respondent No.4. ii) That his Hon’ble Court may be pleased to issue the writ in the nature of mandamus or any other appropriate writ order or direction directing the respondents to release the arrears of pension along with interest @9% p.a.”

Learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the
Judgment passed by a coordinate Bench of this Court in CWP No.11004 of 2025, titled as Reshmo Devi vs. State of H.P. & Ors, on 10th July, 2025 along with connected matters (Annexure P-12). He submits that the respondents have earlier rejected the case of the petitioner vide Annexure P-10 and P-11 on the premise which is not in consonance with the law laid down in judgment ibid (Annexure P-12). He further submits that the petitioner will be satisfied in case the respondent No.2 is directed to re-consider the case of the petitioner in light of judgment passed by the coordinate bench of this Court in CWP No.11004 of 2025, titled as Reshmo Devi vs. State of H.P. & Ors, on 10th July, 2025 along with connected matters (Annexure P-12).

Accordingly, the petition is disposed of without making any comments on the merits of the case of the petitioner. It is directed that respondent No.2 shall reconsider the case of the petitioner in light of the judgment

passed by the coordinate bench of this Court in CWP No.11004 of 2025, titled as Reshmo Devi vs. State of H.P. & Ors, on 10th July, 2025 along with connected matters (Annexure P-12), within eight weeks from today by passing a speaking order.

Pending miscellaneous application(s), if any, also stand disposed of.
