This is the first bail application filed under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 181/2025 registered at Police Station, Tikrapara, ADITI DIWAN KAIWART Digitally signed by ADITI DIWAN KAIWART Date: 2025.05.29 11:26:37 +0530
2 (MCRC No. 4080 of 2025) District Raipur (C.G.), for the offence punishable under Section 21-C of the Narcotic Drugs and Psychotropic Substances Act,
1985.

Case of the prosecution, in brief, is that on 06.03.2025, the Police received secret information from the informant and on the basis of such information, the Police nabbed the applicant and another co-accused at Naya Bus Stand, Bhatagaon, Raipur, who were in a motorcycle and seized 105 bottles of cough syrup of codin phosphate and triprolidine hydrochloride syrup onerex TM each containing 100 ML from their possession. Thereafter, the applicant was arrested for the offence under Section 21-C of the NDPS Act.

Learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated in this case. He would further submit that the applicant had only gone to the house of the co-accused Shamsad Ansari and the contraband articles which were above the commercial quantity were recovered from the vehicle of Shamsad Ansari, whereas the applicant had no knowledge about the said article. It has been further submitted that the applicant is the sole bread runner of his family and is in jail since 06.03.2025, which is causing financial hardships to his family. That, the charge- sheet has not been filed in this case before the competent
3 (MCRC No. 4080 of 2025) court and the conclusion of the trial may take quite long time. Accordingly, he prays for enlarging the applicant on regular bail.

Learned counsel appearing for the State/non-applicant would oppose the bail application and submits that the applicant was also sitting in the said vehicle along with the other co-accused Shamsad Ansari from which the contraband article much above the commercial quantity was recovered, and as such, the applicant is not entitled to be released on bail.
5. I have heard learned counsel appearing for the parties and perused the case diary.

Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and further considering the fact that the applicant was also sitting in the said vehicle along with the other co- accused Shamsad Ansari from which the contraband article was recovered and which was much above the commercial quantity and the trial is still in progress, as such, I am not inclined to allow this bail application.
7. Accordingly, the bail application of the applicant – Vasim Jafar, filed under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023, involved in Crime No. 181/2025 registered at Police Station, Tikrapara, District Raipur (C.G.), for the offence
4 (MCRC No. 4080 of 2025) punishable under Section 21-C of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected.
8. Office is directed to send a certified copy of this order to the concerned trial Court for necessary information.
