1. Heard Mr. A.Z Ahmed, learned counsel for the petitioner. Also heard Mr. B Sarma, learned Additional Public Prosecutor for the State of

2. By this application under Section 528 of the BNSS, 2023 the petitioner has prayed for setting-aside the order of Distress Warrant issued on 15.07.2025 and the subsequent order of NBWA dated 20.08.2025 passed by the Ld. Principal Judge, Family Court, Barpeta in F.C.(Crl.) Case No. 517/2023.
3. Mr. A.Z Ahmed, learned counsel for the petitioner submits that the petitioner is ready to co-operate with the trial of the case and would appear before the Ld. Trial Court on the next date without fail.
4. As such, it is directed that the petitioner should appear before the Ld. Principal Judge, Family Court, Barpeta within a period of 10(ten) days from the date of this order without fail and if he fails to appear, then law would take its own course.
5. Till then the NBWA as well as the Distress Warrant issued against the petitioner may be kept in abeyance.
