The petitioner-Corporation has assailed the award dated 01.10.2021 passed by the Industrial Tribunal, Bangalore, in I.D.No.32/2013. 3. It is submitted that the dispute is amicably settled between the parties and terms and conditions of the settlement are reduced in joint memo. The joint memo is submitted before the Court. 4. The terms of the settlement are extracted as under: “JOINT MEMO The WP filed against the award in ID.No.32/2013 dated 1.10.2021 on the file of - 3 - NC: 2025:KHC:7356 WP No. 12262 of 2024 the Industrial Tribunal, Bengaluru, has been settled between the parties on the following terms and the award may kindly be modified as under: 1. The basic pay of the respondent, withholding of two increments with cumulative effect is modified as withholding of two increments without cumulative effect from the date of punishment till the date of retirement. 2. He is not entitled for difference of gratuity on modification of punishment. 3. The parties to the proceedings have agreed for the above terms.” 5. This Court has perused the terms of settlement. This Court does not find any impediment to accept the settlement and settlement is found to be lawful. Accordingly, the joint memo is accepted.
