Counsel submits that all the information was received by the investigation under Section 23(2) of BNS (under Section 27 of Evidence Act) but no recovery was made in pursuance of the information.
4. Learned Public Prosecutor opposes the submissions made by the counsel for the petitioner.
5. I have considered the contentions.
6. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, as also the fact that allegation of causing firearm injury is against the co-accused person; petitioner is in custody since 03.10.2024; charge-sheet has been filed and trial will take time in its conclusion, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application.
