[2]
Captioned contempt case has been filed alleging breach of ‘order dated 28.07.2025 made in WA No. 92 of 2023 by a Division Bench of this Court’ (hereinafter ‘said order’ for the sake of convenience and clarity). [3]
On 31.10.2025, a Division Bench of this Court issued notice to ‘R1’ (‘first respondent’) and ‘R2’ (‘second respondent’) in the captioned contempt case. [4]
Today, Mr. W. Niranjit, learned State Counsel for R1 and Mr. L. Sanamacha, learned counsel for R2 are before this Court. As would be evident from the narrative thus far, notice has not been issued to R3. [5]
Be that as it may, all the aforesaid counsel before this Court bring to our notice that said order has been carried to Hon’ble Supreme Court by State vide SLP (Civil) No. 33560/2025, Hon’ble Supreme Court in and by order dated 16.12.2025 has issued notice and also stayed the effect of operation of the said order. [6]
As Hon’ble Supreme Court is seized of the matter and as effect and operation of the said order has been stayed, captioned contempt case is closed albeit making it clear that all the rights and contentions of contempt petitioners are preserved for coming back to this Court by way of fresh contempt case if need arises, which will obviously depend on outcome of the proceedings in Hon’ble Supreme Court. [7]
A scanned reproduction of the afore-referred 16.12.2025 order of Hon’ble Supreme Court is as follows :
[8]
In the light of the narrative thus far, captioned contempt case is disposed of as closed albeit with preservation of rights and contentions of the contempt petitioners and obviously the respondents also in the aforesaid
order. [9]
There shall be no order as to costs.
JUDGE
CHIEF JUSTICE FR/NFR Sushil
