JUSTICE SANJEEV KUMAR SHARMA ORDER 28.10.2025 Heard Mr. K. Sarma, learned counsel for the petitioners. Also heard Mr. R.J. Baruah, learned Addl. Public Prosecutor. 2. This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for granting of bail in respect of the accused/petitioners namely i) Shri Debajit Hazarika and ii) Sri Madhuriya Hazarika, in connection with Bishwanath Chariali P.S. Case No. 157/2025 under Section 132/121(1)/117(1)/296/351(3)/3(5) of the BNS. 3. The case of the petitioners is that they were granted bail by the learned Addl. Sessions Judge, Bishwanath by order dated 14.10.2025 and in the said order, it has been observed that the case is based on the same allegations concerning Bishwanath Chariali P.S. Case No. 157/2025 out of which the instant bail application has arisen. 4. Bail was granted by the learned Addl. Sessions Judge considering the period of detention of the accused in the aforesaid case and also the progress of the investigation has reflected in the CD. By now, the Charge Sheet has been submitted as informed by the learned Addl. Public Prosecutor and the petitioners have spent 54 days in custody in connection with the present case. 5. Considering the above, further detention of the petitioners is not necessary. Page No.# 3/3 6. Accordingly, the prayer for bail is allowed. 7. The petitioners shall be released on bail of Rs. 50,000/- with one surety of like amount each in connection with the aforesaid case to the satisfaction of the Eleka Magistrate.
