Counsel for petitioner seeks to withdraw this petition with liberty to seek a clarification concerning the scope of the undertaking given before the Division Bench in FAO(COMM)138/2024, as recorded in the order dated 1st August 2024. 2. The issue relates to the undertaking given by respondent, to not use the impugned Trademark for any product other than bathware and paints. 3. The grievance is that not only is respondent stating themselves to be GM Sanitaryware, but also the brochure of the sanitaryware products carries the logo ‘GM’. 4.
