Opposite parties CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 01.05.2025 01. 1. Heard Mr. Mishra, learned counsel for the petitioner. 2. No notices are issued to the opposite parties as the matter is disposed of at the stage of admission. 3. Instant petition is filed by the petitioner seeking closure of the final decree proceeding arising out of C.S. No.117 of 2002 (FD No.94 of 2019) within a stipulated period of time. 4. Mr. Mishra, learned counsel for the petitioner submits that the preliminary decree is of the year 2019 and the proceeding is pending as on the date and furthermore, the opposite parties are taking up construction over the suit schedule property. It is further submitted that the final decree proceeding is needed to be disposed of at the earliest in order to upkeep and preserve the interest of the parties involved. Considering the submission as above, the Court is inclined to direct the learned court below to consider early closure of the final decree proceeding arising out of the suit. 5. Accordingly, it is directed. 6. In the result, the CMP stands disposed of with a direction to learned 1st Additional Civil Judge (Senior Division), Balasore to conclude the final decree proceeding corresponding to C.S. No.117 of 2002 (FD No.94 of 2019) as expeditiously as possible preferably within a period of ten weeks from the date of receipt of a copy of this order and till such time, the parties are directed to maintain status quo in respect of the subject matter involved.
