The petitioner is apprehending his arrest in connection with Jariyagarh P.S. Case No. 08/2025, registered under sections 317, 3(5) of B.N.S, 2023 and section 30(ii) of the Coal Mines Act, and under section 33 of the Indian Forest Act, pending in the Court of learned Chief Judicial Magistrate, Khunti. 3. Learned counsel for the petitioner submits that petitioner is owner of the vehicle in question and even quantity of coal loaded in the said vehicle has not been disclosed. He submits that petitioner has two criminal antecedents. 4. Learned counsel for the State opposes the prayer and submits that petitioner is having three criminal antecedent and even he has not complied notice under section 35(3) of BNSS, 2023. 5. At this stage, learned counsel for the petitioner seeks permission to withdraw this anticipatory bail application with liberty to move before the learned court. 6. Learned counsel for the State has got no objection. 7. Accordingly, this anticipatory bail application is dismissed as withdrawn with the aforesaid liberty.
