This appeal is directed against the order dated 25.07.2025 passed by the learned Additional Sessions Judge-II, Chatra in Misc. Criminal Application No. 1401/2025, arising out of Piparwar P.S. Case No. 49/2023 (S.T. Case No. 100/2025), whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that the Police had apprehended several extremists and from the apprehended accused persons arms and ammunitions were recovered. Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on account of the confessional statement of some of the co-accused persons including Naresh Kumar Bhokta who has been granted bail by a coordinate Bench of this Court in Criminal Appeal (D.B.) No. 208 of 2024. It has further been submitted that several similarly situated co- accused persons have been granted bail by this Court. Learned counsel adds that the appellant is in custody since 21.12.2024. Neutral Citation No. ( 2025:JHHC:30347-DB ) -2- Learned A.P.P. has opposed the prayer for bail of the appellant. On consideration of the manner of implication of the appellant and the fact that several co-accused have been granted bail as noted above, we while setting aside the order dated 25.07.2025 passed by the learned Additional Sessions Judge-II, Chatra in Misc. Criminal Application No. 1401/2025, arising out of Piparwar P.S. Case No. 49/2023 (S.T. Case No. 100/2025), direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Chatra in S.T.
