(Oral) Petitioner herein, who at present is working as GSSS Aerla, District Kangra, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide her pending representation (Annexure P-2), whereby she has prayed for her transfer from present place of posting to one of the stations, as detailed in the representation, on medical grounds. 2. It has been averred in the petition, which are duly supported by an affidavit, that petitioner has suffered serious injuries in the accident, as a result thereof, she is on leave. Since on account to the injuries sustained in the accident, petitioner is unable to take
care of herself, she has sought transfer from the present place of posting to one of the stations, as detailed in the representation, where her other family members reside. 3. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. Rajan Kahol, learned Additional Advocate General. Mr. Kahol, fairly states that representation, if any, filed by the petitioner for her transfer on medical grounds shall be considered and decided in accordance with law. 4. Since it is quite apparent from the pleadings adduced on record that petitioner has already completed normal tenure at present place of posting, coupled with the fact that she has suffered serious injuries in theaccident and transfer Policy enables an employee to seek transfer on medical grounds, this Court sees no impediment in issuing direction to the respondents to consider and decide the representation of the petitioner expeditiously, preferably within three weeks from today. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders. Pending applications, if any, stand disposed of.
