By way of the present Execution Petition, petitioner seeks compliance of order dated 10.05.2023 passed by the Co-ordinate Bench of this Court in CWP No.2671 of 2023, titled as Narender Kumar Versus State of HP & others.

Counsel for the State has placed on record communication dated 02.09.2025 addressed to Advocate General by Executive Engineer, B&R Division, HPPWD, Dodra Kawar, whereby, Office Order dated 30.08.2025, issued by Superintending Engineer, 14th Circle, HPPWD, Rohru, has been enclosed. Perusal of the same, would go on to show that the petitioner has been granted work charge status on notional basis from retrospective date, i.e. w.e.f. 01.01.2002 on completion of 8 years of continuous service with 240 days in each calendar year in supersession to earlier order dated 29.12.2006. The petitioner has been held not entitled to actual
monetary benefits and no arrears of pay, in pursuance of the directions passed by the Apex Court in Civil Appeal No.1595 of 2025 arising out of SLP (C) No.23016 of 2023 titled as the State of Himachal Pradesh & Ors. Versus Surajmani & another alongwith connected matters, decided on
06.02.2025.

It is also brought to our notice that pay fixation shall also be done within a period of three days as per the said communication.

Accordingly, the present Execution Petition is closed by leaving the State to abide by its undertaking, as referred to above.
