03/ 09.09.2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Giridih Town P.S. Case No. 79 of 2022, registered for the offences under Sections 406, 420, 467, 468, 471, 506, 120-B and 34 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Giridih.

Learned counsel appearing for the petitioner submits that the petitioner is the Power of Attorney Holder of Kusum Kumari and Abhishek Raj. He submits that allegations are made that showing the informant as dead, the land has been sold to one of the accused Harendra Singh Saluja and the persons, who have provided the power of attorney to the petitoner have already been provided the privilege of anticipatory bail in A.B.A. No. 3979 of 2024 by the co-ordinate bench. He further submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-14 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submit that the allegations are there of showing the

informant as dead and the land in question has been transferred.

Considering that the petitioner is the Power of Attorney Holder of Kusum Kumari and Abhishek Raj and both of them have already been provided the privilege of anticipatory bail in A.B.A. No. 3979 of 2024 by the co-ordinate bench and further the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-14 of the petition, I am inclined to provide the privilege of anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is hereby
directed to surrender before the learned court within three weeks from today, and in the event of her surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Giridih, in connection with Giridih Town P.S. Case No. 79 of 2022, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
