PUBLIC PROSECUTOR The Court made the following Order: This Criminal Petition, under Sections 482 of BNSS, has been filed by the petitioner/Accused, seeking anticipatory bail, in Crime No.173 of 2024 of Narasaraopet Rural Police Station, Palnadu District registered for the offence punishable under Sections 354A, 506, 509, 376(2)(f) and 376(2)(i) IPC. 2. Case of the prosecution is that on 29.06.2024, the defacto complainant filed a report before the police stating that she is residing at her elder son’s house and her granddaughter is mentally disabled, as such, she used to look after her needs in the house when her family members are engaged in farming works. About five days back, when she was engaged in housekeeping works, the accused approached victim girl and took her into his house by chitchatting her, later on her suspicion she visited house of accused and witnessed accused touching upon all over body of 2 her granddaughter in obscene manner, and she informed the same to her family members and elders, as the elders failed to settle the issue at village level. 3. Heard. Perused the record. 4. On perusal of the material on record goes to show that the petitioner is uncle of the victim girl and he is alleged to have taken the girl to his house by saying gullible words. It is alleged that the accused was talking to the victim girl by touching her body. Thereafter, the victim girl communicated the same to her grandmother that the accused committed rape on her. Going by the accusations contained in the First Information Report and the statement that has been recorded, it would go to show that the accused being the uncle of the innocent victim girl has taken the advantage of her disability, committed the said act. 5. Since the investigation is pending, at this stage, this Court is not inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the Criminal Petition is dismissed. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. _____________________ K.
