For the State : Mr. Shree Prakash Jha, A.P.P. ------ 05/ 10.09.2025 Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners are apprehending their arrest in connection with Chas (M) P.S. Case No. 78 of 2025, registered for the offences [2025:JHHC:27473] -2- under Sections 126(2), 127(2), 115(2), 132, 351(3), 352, 3 (5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Bokaro. 3. Learned counsel appearing for the petitioners submits that it has been alleged that 25-30 persons have assembled at the spot and tried to take away the vehicle. He submits that although the petitioners are named in the FIR, however, as to what overt act has been done by these petitioners have not been disclosed in the FIR. He further submits that the petitioners are having no criminal antecedent. 4. Learned A.P.P. for the State has opposed the prayer and submit that the allegations are there of interfering in discharging of official duty. 5. Considering that there is no specific allegation against these petitioners and it has been alleged that on the same day, another FIR has also been filed for the same incident and further the petitioners are having no criminal antecedent, I am inclined to grant anticipatory bail to the petitioners. 7. Accordingly, the petitioners, named above, are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st class, Bokaro, in connection with Chas (M) P.S. Case No. 78 of 2025, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Amitesh/-
