By this application, the petitioner has prayed for pre-arrest bail in connection with PRC P.S. Case No. 76/2024 registered under Section Page No.# 2/3 419/366/376/372/34 IPC corresponding to Fakirganj P.S Case No. 252/2019 pending before the Court of Sub-Divisional Judicial Magistrate, Dhubri. 3. The FIR dated 05.10.2019 reveals that the victim was in a relationship with the petitioner and that the petitioner had promised to marry her but it is stated therein that the petitioner kidnapped her alongwith others and took her to the New Bongaigaon Railway Station and brought them Delhi by train where it is alleged that the petitioner and others had sold her and her friends to some unknown person. It is also stated that the petitioner had raped her against her will. 4. The Police on completion of the investigation submitted Charge-sheet against the petitioner and others under Section 419/366/376/372/34 IPC. Thereafter, by Order dated 08.04.2024, cognizance under the various provisions of law are taken against the petitioner and summons were issued. 5. Mr. S. Paul, learned counsel for the petitioner submits that the petitioner had received the summons issued by the Court and would appear before the Trial Court and would face the trial. 6. In view of the said submissions, this Court deems it fit that the petitioner be released on pre-arrest bail on furnishing bail bond of Rs. 20,000/- with 1 local surety of like amount to the satisfaction of the Sub-Divisional Judicial Magistrate, Dhubri under the following conditions:- 1. The petitioner will appear before the Trial Court and will make himself available for interrogation as and when called for. 2. The petitioner will not temper with the evidence or influence any other witnesses. 3. The petitioner will not leave his place of residence without prior Page No.# 3/3 permission of the learned Court mentioned above. 7. Accordingly, the Anticipatory Bail Application stands disposed of.
