Learned A.P.P. appearing on behalf of the State, at the outset, has informed that during pendency of this appeal, which was filed on behalf of the appellant for grant of anticipatory bail, the process under Section 82 Cr.P.C. has been issued by the learned Trial Court and therefore, it is submitted on behalf of the State that the instant criminal appeal is not maintainable. It is further submitted that although the interim relief was granted to the appellant on 16.10.2024but the process under Section 82 Cr.P.C. was already issued on 01.10.2024, as evident from para 83 of the case diary.
3. In view of the submission made by learned A.P.P., learned counsel for the appellant seeks to withdraw this appeal.
4. In view of the aforesaid facts and submission of learned counsel for the parties, the instant criminal appeal is disposed of as withdrawn.
